Sharing Tenants, Swapping Tenants
January 1st, 2017
This can be very tricky. You will often get 2 people sharing an apartment or house.
One may often decide to leave earlier than the other so the remaining tenant will need a replacement. In this case, Landlords may be tempted to simply treat the new occupier as a new tenant. It is advised that any changes to occupants sharing tenancy should be considered as a new tenancy β not βold tenant, new tenantβ.
This means both need to be involved in signing new room agreements, new deposits, management of the old deposits, new inventory, and if necessary new terms such as a change in rent. Getting all the ducks in a row in this instance, and making sure legal responsibilities are mutually renewed, can be tricky and time-consuming but helps avoids exacerbating issues down the line.
